Pearland Rollover Auto Accident Claims Four Passengers, Speeding Driver Pronounced Dead
Auto accidents that end in fatality are always heartbreaking. That heartbreak is compounded when multiple lives are taken, including those of minor passengers. Unfortunately, a severe rollover auto accident occurred in Pearland this week that left five people dead, including a minor passenger. The driver of one of the cars, who was speeding, sadly also passed away.
According to local news outlets covering the story, the tragic auto accident occurred on Saturday, October 16, in the early morning at 7:28pm. The scene of the accident was the 14700 block of Highway 266 in the city of Pearland in the Houston region. Investigators report that a vehicle with three people inside was speeding southbound when it collided with another vehicle, causing the vehicle it hit to rollover. Four of the five passengers in the vehicle were ejected during the rollover. Three people of the four passengers passed away at the scene, one of which was a minor. The driver of the speeding car was severely injured and died at the hospital. The fourth passenger of the car that rolled over was also taken to the hospital for medical treatment. The two passengers of the speeding car were also treated at an area hospital.
Houston Wrongful Death Cases – What Happens if the Person Responsible Dies?
The investigation into the accident is still pending and there are many questions left to be answered, such as who was at fault and how the accident occurred. However, the horrific case highlights not only many concerns about driver safety on the road, but also poses a hypothetical legal question for surviving victims and surviving family members of the deceased victims: in Houston, is there any justice for victims of auto accidents and family members of deceased victims of auto accidents if the driver or drivers responsible also lose their lives?
Texas personal injury laws provide recovery for victims of accidents that were caused by the negligence or carelessness of another person. In addition, Texas wrongful death laws enable family members of deceased victims of accidents that were caused by another person’s negligence to recover damages for the loss of their loved one. Fortunately, under Texas wrongful death laws, family members of victims of auto accidents caused by another person’s negligence or carelessness can still seek compensation even if the person who caused the accident dies, by allowing surviving family members to bring suit against the executor or administrator of the estate of the person at fault. This applies if the person responsible dies before a wrongful death case is initiated or if the person responsible dies during the pendency of an active case. Therefore, family members who wish to seek justice for a loved one lost in an auto accident can do so, even if the person responsible has also passed away.
